What do I do if I have received a Civil Penalty Ticket for a violation of the City's Zoning Ordinance?

If you have received a Civil Penalty Ticket for violation(s) of the provisions of the City’s Zoning Ordinance you may choose to respond in any of the following three ways:

1. Admit Violation = Admission of guilt.

  • Check the “Admit Violation” box on the bottom right hand corner of the Notice of Violation form.
  • Complete the required information, found at the bottom right hand corner of the form, and sign the Civil Penalty Ticket.
  • Return a signed copy of the ticket and the indicated penalty amount to the City Treasurer’s Office. This will indicate your intent to correct the violation.
  • Correct the identified violation within the time period specified on the left hand side of the Civil Penalty Ticket.
  • Don’t violate again or you will get another ticket.

2. No Contest = No admission of Guilt; however you will correct the sited violation.

  • Check the “No Contest” box on the bottom right hand corner of the Civil Penalty Ticket.
  • Complete the required information, found at the bottom right hand corner of the form, and sign the Civil Penalty Ticket.
  • Return a signed copy of the ticket and the indicated penalty amount to the City Treasurer’s Office. This will indicate your intent to correct the violation.
  • Correct the identified violation within the time period specified on the left hand side of the Civil Penalty Ticket.
  • Don’t violate again or you will get another ticket.

3. Contest in Court = No admission of guilt. You are contesting the issuance of the Civil Penalty Ticket before the General District Court of Fairfax, Virginia.

  • Check the “Contest in Court” box on the bottom right hand corner of the Civil Penalty Ticket.
  • Complete the required information, found at the bottom right hand corner of the form, and sign the Civil Penalty Ticket (This is not an admission of guilt).
  • Return a signed copy of the Civil Penalty Ticket to Department of Community Development and Planning indicating your intent to Contest in Court. Ticket must be returned within 15 days of issuance.
  • Your request to appear in Court will be forwarded to the City Attorney for processing. All enforcement action on your property will be halted, once the properly completed and signed Civil Penalty Ticket has been received, and you will be notified by the City Attorney regarding your hearing date.

* YOU MAY NOT APPEAL CIVIL PENALTY TICKETS TO THE BOARD OF ZONING APPEAL.
