What do I do if I received a Zoning Notice of Violation?

If you have received a Notice of Violation for violation of the provisions of the City’s Zoning Ordinance you may choose to respond in any of the following three ways:

1. Admit Violation = Admission of guilt.

  • Check the “Admit Violation” box on the bottom right hand corner of the Notice of Violation form.
  • Complete the required information, found at the bottom right hand corner of the form, and sign the Notice of Violation form.
  • Return a signed copy of the form to Department of Community Development and Planning indicating your intent to correct the violation.
  • Correct the identified violation within the time period specified on the left hand side of the Notice of Violation Form.
  • Don’t violate again or you will get a ticket.

2. No Contest – No admission of Guilt; however you will correct the sited violation.

  • Check the “No Contest” box on the bottom right hand corner of the Notice of Violation form.
  • Complete the required information, found at the bottom right hand corner of the form, and sign the Notice of Violation form.
  • Return a signed copy of the form to Department of Community Development and Planning indicating your intent to correct the violation.
  • Correct the identified violation within the time period specified on the left hand side of the Notice of Violation Form.
  • Don’t violate again or you will get a ticket.

3. Appeal to the Board of Zoning Appeals (BZA) – No admission of guilt and you contest the issuance of the Zoning Notice of Violation before the Board of Zoning Appeals.

  • Check the “Appeal to BZA” box on the bottom right hand corner of the Notice of Violation form.
  • Complete the required information, found at the bottom right hand corner of the form, and sign the Notice of Violation form.
  • Complete the required Zoning Appeal form.
  • Return a signed copy of the Notice of Violation form, the Zoning Appeal form, and the required appeal fee of $500 to Department of Community Development and Planning indicating your intent to appeal the Notice of Violation.
  • The Notice of Violation must be returned within 30 days of issuance> Failure to do so constitutes forfeiture of your right to an appeal.
  • All enforcement action on your property will be halted, once all of the required documents and fee have been received, and you will receive a hearing date before the Board of Zoning Appeals to state your appeal.

* YOU MAY NOT CONTEST A NOTICE OF VIOLATION IN COURT WITHOUT FIRST APPEALING TO THE BOARD OF ZONING APPEALS.
